FATHOM Terms of Service
Effective October 6, 2026
These terms govern your use of the websites, client portal and services of Fathom Digital LLC ("Fathom", "we", "us"), including fathom.digital and its subdomains and Fathom Sites, our platform for hosting client websites and managing advertising (together, the "Services"). By using the Services you agree to these terms. If you are a client, any written agreement or quote between you and Fathom also applies, and it controls where it differs from these terms.
Our services
Fathom designs, builds and hosts websites for small businesses, and can manage Google Ads advertising for them. Clients use the portal at my.fathom.digital to view their site, request changes, edit content and see leads and advertising results. Prices, advertising credit and payment terms are agreed separately with each client.
Website previews
We sometimes build a preview of a refreshed website for a business before it becomes a client, using information the business has already published. Previews appear at addresses such as name.fathom.digital. A preview is a proposal from Fathom: it is not affiliated with or endorsed by that business unless the business becomes our client. Any business can ask us to take its preview down by emailing hello@fathom.digital, and we will remove it promptly.
Accounts
Portal accounts are by invitation. Sign-in links are sent by email and are for you alone, so keep access to your email account secure. Tell us promptly if you think someone else has used your account.
Your content
Your business's text, photos, logos and other materials remain yours. You give Fathom permission to copy, adapt, host and display them as needed to provide the Services. You confirm that you have the right to the materials you give us and that your site's information (such as prices, hours and claims about your business) is accurate.
Advertising
When a client asks us to advertise, we run campaigns on its behalf in Google Ads accounts that Fathom manages. Spend is drawn from the client's advertising credit, and campaigns pause when the credit runs out. Advertising is subject to Google's own policies, which may limit or reject ads. We work to get good results, but we cannot guarantee any number of clicks, calls, leads or sales.
Acceptable use
You agree not to use the Services to break the law, infringe anyone's rights, publish false or misleading information, send spam, or interfere with or attempt to gain unauthorized access to the Services. We may remove content or suspend access that violates these terms.
Our property
The Platform, its software and Fathom's own designs, templates and tools belong to Fathom. What happens to a client's website when service ends is agreed with that client.
Third-party services
The Services rely on providers such as web hosts, email delivery services and Google. Their availability and terms are outside our control, and we are not responsible for their acts or outages.
Ending service
A client may stop using the Services at any time by letting us know. We may suspend or end the Services for anyone who breaks these terms or fails to pay amounts due. Sections that by their nature should survive (such as content ownership, disclaimers and limits of liability) continue after service ends.
Disclaimers
Except as agreed in writing, the Services are provided "as is" and "as available". We do not promise that they will be uninterrupted or error-free, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement to the extent the law allows.
Limitation of liability
To the extent the law allows, Fathom is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services is limited to the amount you paid Fathom for the Services in the twelve months before the claim arose.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
Changes
We may update these terms. We will change the effective date above, and tell clients directly about significant changes. Continuing to use the Services after a change means you accept the updated terms.
